PORSCHE ATLANTA NORTHEAST - RIDE-ALONG EVENT WAIVER & CONSENT AGREEMENT

IMPORTANT: PLEASE READ CAREFULLY BEFORE PARTICIPATING
By providing your name and email address below and checking the box to confirm agreement, you are electronically signing this Waiver & Consent Agreement. You affirm that you have read, understood, and agree to all terms and conditions outlined below. This agreement is effective for the ride-along event organized by Porsche Atlanta Northeast and any related activities on April 19, 2025.
● I, the undersigned participant (“Participant”), voluntarily participate as a passenger in a ride-along event organized by Porsche Atlanta Northeast (“the Event”). I fully understand and accept that being a passenger in a motor vehicle involves inherent risks and dangers, including but not limited to collisions, malfunctions, and accidents that may result in serious injury, property damage, or death. I voluntarily assume all such risks, whether foreseen or unforeseen.
● I agree that neither Porsche Atlanta Northeast nor its associates—Jim Ellis Automotive Group, Boundless Racing, 24 Hour Legal, Magic City Motorsport (collectively “the Released Parties”), nor their employees, agents, officers, partners, sponsors, affiliates, or representatives—shall be held liable or responsible for any injury, loss, damage, distress, or death occurring during or as a result of my participation in the Event. I acknowledge that any accident, injury, or incident is not covered under the insurance provided by Porsche Atlanta Northeast or its associates, and I am solely responsible for my own personal safety and insurance coverage.
● I, my estate, next of kin, and any others who would seek to stand in my place, hereby waive all legal claims against the Released Parties arising from or relating to the Event, including those related to vehicle performance, mechanical failure, road conditions, negligence, or actions of the driver or any third party.
2. VEHICLE ASSIGNMENT AND ELIGIBILITY
● I acknowledge that I will participate in a ride-along in a vehicle assigned by Porsche Atlanta Northeast, with the specific vehicle type varying based on age or other eligibility criteria (e.g., participants aged 25 and older may be assigned high-performance vehicles, while others, including families, may be assigned alternative models). I assume all risks associated with the assigned vehicle and ride-along, including but not limited to collisions, malfunctions, and accidents, and waive any claims against the Released Parties related to the vehicle’s performance or assignment.
● Participants under 18 (minors) may participate in ride-alongs with written consent from a parent or legal guardian. I certify that I am 18 or older, or if under 18, my parent or guardian has reviewed and agreed to these terms on my behalf. Minors must present proof of age and parental consent at check-in.
● I agree to indemnify and hold harmless the Released Parties from any claims, damages, costs, or legal fees incurred as a result of my participation in the Event.
● By providing my name and email address, I consent to receive email communications related to the Event, including follow-ups regarding my experience. I may be contacted by representatives from Porsche Atlanta Northeast, 24 Hour Legal, Boundless Racing, or Magic City Motorsport regarding inquiries about the Event, services, promotions, or future collaborations. My contact information will be handled per applicable privacy policies and will not be sold or shared outside these affiliated organizations without my consent.
● If any provision of this agreement is found invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
7. ARBITRATION, CHOICE OF LAW, AND VENUE
● Any dispute, claim, or controversy arising from this waiver or the Event, including claims of negligence, shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall occur in Atlanta, Fulton County, Georgia, and be governed by the laws of the State of Georgia. The arbitrator’s decision shall be final and binding, with limited judicial review under the Federal Arbitration Act.
● If arbitration is unavailable or unenforceable, any legal action shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and I consent to the jurisdiction and venue of such courts. Georgia law shall govern all proceedings, whether in arbitration or court. I waive my right to a jury trial or class action lawsuit, and these provisions survive the termination of this agreement.
● This agreement shall be interpreted and construed as a whole according to its plain meaning and the mutual intent of the parties, without applying any rule of construction that would interpret ambiguities against the drafting party (e.g., the contra proferentem doctrine). Both parties acknowledge they have had the opportunity to review this agreement, and any ambiguity shall be resolved by considering the entire document and relevant circumstances, not by favoring the non-drafting party.
